These terms and conditions outline the rules and regulations for the use of GOPromo’s Platform, located at https://gopromo.org.
By accessing this Platform we assume you accept these terms and conditions. Do not continue to use GOPromo if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this Platform and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of us. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
You are entitled to post the Political Ads on our Platform and have all the necessary licenses and consents to do so;
The Political Ads do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party;
The Political Ads do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material which is an invasion of privacy;
The Political Ads will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.
You hereby grant GOPromo.org a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Political Ads in any and all forms, formats or media.

We employ the use of cookies. By accessing GOPromo, you agreed to use cookies in agreement with the GOPromo.org’s Privacy Policy.
Most interactive websites and Software-as-a-Service (SaaS) platforms use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.

If you are one of the organizations listed above and are interested in linking to our Website, you must inform us by sending an e-mail to GOPromo.org. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.
Approved organizations may hyperlink to our Website as follows:
By use of our Corporate Name; or

No use of GOPromo’s logo or other artwork will be allowed for linking absent a trademark license agreement.

Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.
Content Liability
We shall not be held responsible for any content that appears on your Website or Social Media Platform, including by not limited to Facebook, Twitter, Instagram, and/or Snapchat, nor shall we be held responsible for any content that is published in the form of a Political Ad by a Candidate or Campaign user on our Platform, or in turn published on any of the aforementioned Social Media Platforms via one of our users. You agree to protect and defend us against all claims that is rising on your Website or Social Media Platform. We shall not be held responsible for any link(s) that should appear on any Website or Social Media Platform that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.
Reservation of Rights
We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and/or privacy policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.
Removal of Links / Political Ads from our Platform
If you find any link or Political Ad on our Platform that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links and/or Political Ads but we are not obligated to or so or to respond to you directly.
We do not ensure that the information on this Platform is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the Platform remains available or that the material on the Platform is kept up to date.
Disclaimer
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our Platform and the use of this Platform. Nothing in this disclaimer will:
limit or exclude our or your liability for death or personal injury;
limit or exclude our or your liability for fraud or fraudulent misrepresentation;
limit any of our or your liabilities in any way that is not permitted under applicable law; or
exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.
We will not be liable for any loss or damage of any nature incurred on our Platform.
Data Storage and Security
GOPromo acknowledges that in the course of providing the Software-as-a-Service (SaaS) platform (“Platform”), it may collect, process, and store personal data of the Customer and its authorized users (“Data”). This section outlines the terms and conditions governing the storage of personal data by GOPromo.
Data Storage
GOPromo shall store the Data in accordance with applicable data protection laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) and any other relevant national or regional data protection laws (“Applicable Laws”). GOPromo will only retain the Data for as long as necessary to fulfill the purposes outlined in the agreement between GOPromo and the Customer.
All Platform users acknowledge and agree that the Data may be stored on servers located in various jurisdictions. GOPromo shall take reasonable measures to ensure that any transfer of Data outside the Customer’s jurisdiction complies with the requirements of Applicable Laws, including implementing appropriate safeguards such as standard contractual clauses or other lawful mechanisms for cross-border data transfers.
Data Security
GOPromo shall implement and maintain appropriate technical and organizational measures to protect the security, confidentiality, and integrity of the Data stored on the Platform. These measures shall be designed to prevent unauthorized access, disclosure, alteration, or destruction of the Data.

All Platform users acknowledge that no system can guarantee absolute security and that GOPromo’s security measures are subject to technological constraints, evolving industry standards, and malicious activities. The User understands and agrees that GOPromo cannot be held liable for any unauthorized access, loss, or disclosure of the Data unless such access or disclosure was a result of GOPromo’s failure to meet its obligations under this section.
The User shall be responsible for maintaining the confidentiality and security of any access credentials or authentication mechanisms provided by GOPromo for accessing the Platform. The User shall promptly notify GOPromo in writing in the event of any known or suspected unauthorized access to the Data or breach of security.
Data Breach Notification
In the event of a data breach affecting the Data stored on the Platform, GOPromo shall notify the User without undue delay after becoming aware of the breach. The notification will describe the nature of the breach, the likely consequences, and the measures taken or proposed to address the breach.
GOPromo shall cooperate with the User and provide reasonable assistance in investigating and mitigating the effects of any data breach. The User acknowledges that GOPromo’s obligation to notify the User of a data breach is not an admission of liability, and the User agrees to release GOPromo from any liability arising from the data breach, except where such breach results from GOPromo’s gross negligence or willful misconduct.
Data Deletion
Upon termination or expiration of the agreement between GOPromo and the User, GOPromo shall, within a reasonable period of time, delete or anonymize the Data stored on the Platform, unless otherwise required by Applicable Laws.
GOPromo may retain a backup copy of the Data for a limited period in accordance with its data retention policies or legal obligations. The backup copy will be securely stored and will not be accessible or used unless required for disaster recovery or compliance purposes.
Data Processing Agreement
The parties may enter into a separate Data Processing Agreement (“DPA”) that supplements this section and governs the processing of personal data in more detail. In the event of any inconsistency or conflict between the DPA and this section, the provisions of the DPA shall prevail.
If the parties have not entered into a separate DPA, this section shall constitute the entire agreement between the parties regarding the storage of personal data.
Corporate Structure
GOPromo is a privately owned, for-profit company providing the Software-as-a-Service (SaaS) platform (“Platform”). As a privately owned company, GOPromo operates under its own corporate structure, policies, and governance.
All Platform users acknowledge and agree that GOPromo retains full ownership and control over the Platform, including any intellectual property rights associated with the Platform. Any and all use of the Platform is subject to the terms and conditions outlined in the agreement between GOPromo and the User.
Tax Disclaimer
GOPromo hereby informs all Users that, as a for-profit company, no user of the Platform may deduct any money spent on the Platform for tax purposes. This includes any fees, charges, or payments made by the User in connection with the use of the Platform.
Other Terms
GOPromo is not a 501(c) Organization, political action committee (PAC), Super PAC, or Carey Committee.
No money spent on Political Ads through our Platform is coordinated with the spending of any political party or candidate.
As a Limited Liability Companies (LLC), we are established as a technology platform to perform a number of necessary business functions for Candidates and their campaign.
GOPromo does not provide Political Campaign advice or guarantee any Political Campaign benefits or deductions associated with the use of the Platform. Candidates and Supporters (the Users) are solely responsible for assessing and complying with all applicable tax laws, regulations, and obligations related to its use of the Platform.
Indemnification
All Platform users agree to indemnify and hold GOPromo, its officers, directors, employees, and affiliates harmless from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to any claims made by any User or any third party in connection with the use of the Platform.
GOPromo shall have no liability to any User or any third party for any adverse consequences or liabilities arising from the use of the Platform, including the inability to deduct any expenses related to the Platform for tax purposes, any financial hardship incurred due to the amount spent on Political Ads on the Platform, or any Election defeat that occurs before, during, or after using the GOPromo Platform.
Entire Agreement
This section regarding the corporate structure constitutes part of the agreement between GOPromo and the User and supersedes any prior or contemporaneous understandings, representations, or agreements, whether oral or written, relating to the subject matter herein.
No modification, amendment, or waiver of any provision of this section shall be effective unless in writing and signed by both GOPromo and the User.
By accessing or using the Platform, the User acknowledges that it has read, understood, and agreed to the terms and conditions outlined in this section regarding the corporate structure and tax disclaimer.
